Publishers complained to Telegram for pirated copies of books. Copyright infringement. Rights protection. Bringing to administrative responsibility.
An appeal for copyright infringement was sent to Roskomnadzor, its author is the Association for the Protection of Copyrights on the Internet, which represents the interests of the largest Russian publishing houses, including Eksmo, Mif, AST and others (15 publishers in total). The association complained about Telegram Messenger LLP, which is the owner of the Telegram messenger. The applicant, and in his person, major Russian publishers, asks Roskomnadzor to bring the company to administrative responsibility and impose a fine on it under Part 2 of Art. 13.41 Administrative Code of the Russian Federation. The reason was the failure to fulfill the obligation to remove pirated copies from the channels of the messenger.
Thus, the appeal claims that Telegram still provides free access to illegal, pirated copies of books by Boris Akunin and Mike Omer, which is a direct violation of the Moscow City Court's ruling that ordered them to be removed.
This action was taken as part of the consideration of a statement of copyright infringement. We know of at least two such applications filed by the AST publishing house, both of them filed in connection with the placement of illegal, pirated copies of books by Boris Akunin. In addition, in the future, publishing houses plan to make similar statements regarding the distribution of books by Dmitry Glukhovsky, Guzeli Yakhina, and Stephen King.
In accordance with the law, Telegram had to ensure the blocking of the channel hosting the pirated copy. However, this was not done. Now the owner faces a fine of 800,000 to 4,000,000 rubles.
Also, the above association asked Roskomnadzor to bring Facebook Inc. to administrative responsibility under the same article with the same consequences. for not removing links to pirated copies from his social network Instagram.
The association and publishers believe that the social network promotes the distribution of pirated copies by posting both links to third-party resources and audio with sound tracks. But the first place in terms of the number of identified pirated copies and links to them, they give the telegram.
Due to the fact that the owners of the messenger and the social network do not provide a comprehensive fight against piracy (they simply process links mechanically), according to the association, publishers lose about a fifth of their potential income every year, which is about 1.5 billion rubles. Therefore, publishers decided to actively protect their rights within the legal framework.
