Tax bankrupts "Uncle Dener"

The tax office is bankrupting Uncle Dener.

As follows from the file of arbitration cases, the first bankruptcy procedure, supervision, was introduced in respect of Uncle Dener LLC. The ruling was adopted by the Arbitration Court of the Novosibirsk Region on January 24, 2023. The judges considered the application of the Federal Tax Service No. 17 of the Novosibirsk Region to declare a well-known fast food chain bankrupt justified. The introduction of a monitoring procedure does not mean that a legal entity will necessarily be declared bankrupt as a result of the consideration of the case. It is possible to restore solvency as a result of the actions of the arbitration manager, the conclusion of a settlement agreement with creditors.

As you can see, the tax authorities applied to the court, that is, the Federal Tax Service is going bankrupt "Uncle Dener". Tax claims in the amount of about 2 million rubles (arrears on taxes and fees) were entered by the court in the register of creditors. Nikolaev Anton Vladimirovich was appointed interim manager. Now information about the introduction of the first bankruptcy procedure will be published officially in the Kommersant publication, and other creditors will also be able to include their claims in the register.

Sberbank has already entered the case, as well as Uniline Capital Management LLC as a representative of the bondholders of Uncle Dener LLC. Judging by the file of arbitration cases, the fast food chain also has unfulfilled obligations to the Novosibirsk City Hall. Four claims for debt collection under land lease agreements were satisfied during 2022, one more claim is currently being considered and one has only been registered. The recovered non-payment of rental payments is not as significant as tax debts, and amounts to approximately 200,000 rubles.

"Uncle Dener" was founded in 2009, the director of the fast food chain is Anton Lykov. The limited liability company is owned by A. Lykov and four of his partners - individuals, A. Lykov and L. Suprun each have 33.3% of the authorized capital, A. Suprun 32.3% and A. Pavlov 1%. The company specializes in shawarma and similar street food dishes; there are about 85 company outlets in Novosibirsk and its suburbs. Back in the middle of the pandemic 2020, the owners decided to open a new project - a network of pancakes under the name "Native Pancakes" (in Novosibirsk at that time there was only one network in this niche - "Russian Pancakes"). And for 2021, income amounted to only 11.9 million rubles, as opposed to a net loss of 98.1 million rubles.
