Subsidiary responsibility of the bank management. Bankruptcy. A responsibility. Compensation for damages. Protection of interests.
Former managers of Aksonbank are subject to subsidiary liability in the amount of 523 million rubles.
The Deposit Insurance Agency applied to the Arbitration Court of the Kostroma Region with a claim to involve the former owners of Aksonbank in the subsidy (case No. A31-13748 / 2018). Ex-owner of the bank Andrei Ozerov, former chairmen of the board Alexei Lokhanov and Denis Gomzelev, deputy chairman of the board Veselov, members of the board of directors Anna Palamarchuk and Yuri Romanyuk, chief accountant Maria Petrova. The loss is estimated at 523 million rubles.
During the bankruptcy process, the agency discovered that the people who controlled the bank were creating technical debt and overpriced real estate. In addition, the people who controlled the bank made overpriced payments for the use of the brand and domain name. As a result of these actions, the bank suffered losses.
These circumstances, according to the law, are the basis for bringing the entities that controlled the bank to civil liability in the form of compensation for losses.
Vitaly Vetrov, managing partner of the law firm Vetrov and Partners, will comment on the situation.
It seems that not a single bankrupt case, and even more so, the bankruptcy of a bank, bypasses any bankrupt case without bringing to subsidiary liability. Despite the fact that fear has big eyes, the satisfaction of requirements does not always occur and the persons held accountable have a chance to “fight off” them. Naturally, the preparation for the defense itself, the specific actions (inaction) that each of the defendants committed will be of great importance. One of the important facts, based on publications in the media, is the attempt to transfer the bank under the control of the Central Bank of the Russian Federation. This can be regarded as both the absence of guilt and confirmation of the absence of violations by Aksonbank (its controlling persons) of violations of the law.
