The State Duma intends to ban retail sales of energy drinks to children.
A draft law on limiting the retail sale and consumption in public places of drinks known as energy drinks has been submitted to the State Duma for consideration. The adoption of a separate law is envisaged, and not amendments to existing ones. Draft law No. 273183-8 entered the lower house of the Russian parliament on January 9, 2022.
The bill proposes to completely ban the sale of energy drinks at retail:
- in children's, youth, educational, medical, physical culture and sports organizations, on public transport, including at stops and gas stations. In cultural organizations, the sale of energy drinks is allowed only at catering points (unlike all previously listed organizations);
- minors, that is, citizens under 18 years of age. The law is valid throughout the territory of the Russian Federation without restrictions, that is, it also applies to foreigners and stateless persons.
Also under the ban is the consumption of energy drinks:
at all of the above facilities, except for transport;
minors in public places.
The law defines the term energy drink. It has been established that there are two types of energy drinks: “non-alcoholic tonic drink” and “non-alcoholic energy drink” and are characterized by a certain content of caffeine (at least 15.1 mg per 100 milliliters) and mono- and diasaccharides (at least 10% in dry matter with energy values of at least 44 kcal per 100 milliliters) respectively. The terms "consumption" and "public places" were not clarified. The law is expected to come into force on September 1, 2023.
Since 2018, the production and sale of low-alcohol energy drinks (with an alcohol content of less than 15%) has been banned in the Russian Federation, the circulation of non-alcoholic drinks is not regulated at the federal level. The regions have their own laws on this matter. Thus, the sale of non-alcoholic energy drinks is prohibited in more than 20 constituent entities of the Russian Federation, including Moscow, Leningrad regions and Tatarstan (since November 2 last year).
In December 2022, the Russian Orthodox Church proposed to ban the sale of energy drinks to children. Its representatives indicated that such drinks are used by teenagers when drinking alcohol, as they provide a longer effect. The initiative of the Russian Orthodox Church was supported by the Deputy Prime Minister of the Russian Federation Tatyana Golikova.
