In Russia, online sales of prescription drugs will start next year.
Vladimir Putin signed a law amending FZ-61. Provisions of the federal law No. 405-FZ dated October 20, 2022. The amendments will enter into force on March 1, 2023. Prescription drugs can be purchased remotely. While the online sale of such drugs will be carried out on an experimental basis, therefore, the norms of FZ-405 are of limited use in time and territory. The experiment is carried out:
in the capital, Moscow region and Belgorod regions;
in the period from 01.03.2023 to 01.03.2026
That is, the online sale of prescription drugs will be introduced in three constituent entities of the Russian Federation for exactly three years. The law is published on the portal of regulatory legal acts.
The authorized state body will form a list of medicines that are allowed to be sold online. The following medicines are not allowed to be included in the list:
released on preferential terms (at a discount or free of charge);
containing narcotic and psychotropic drugs, as well as potent substances;
radiopharmaceutical and immunobiological;
medicines that need to be stored only at temperatures below 15 degrees Celsius;
made by pharmacies;
alcohol-containing (with a share of alcohol in the composition of more than a quarter).
It is allowed to remotely sell medicines prescribed for medical use, dispensed by pharmacies by prescription. In particular, it is allowed to issue a prescription in electronic form using the Unified Portal of State and Municipal Services (State Services) or regional portals.
The participants in the experiment are:
- the authorized state body, the Ministry of Health, which also forms the list of drugs. The Ministry of Health provides methodological support for the experiment and reports to the Government on its results;
- local executive authorities in the regions listed above. Departments, committees and health departments carry out information and technical support, monitor the progress of the experiment and report to the Ministry of Health, approve the procedure for selecting medical and pharmacy organizations for participation and conduct such a selection, form a list. They also establish the features of the experiment in a particular region;
- medical organizations and pharmacies that have the right to sell prescription drugs online. Participation in the experiment is voluntary, you can refuse it in writing.
The regulation on the experiment and the requirements for medical and pharmacy organizations are approved by the Government of the Russian Federation.
When delivering medicines, medical and pharmacy institutions are required to identify the buyer.
