Revocation of a license from a bank. 115-FZ. Violation of the law. Doubtful deals. Consequences for bank customers. Challenging operations for transferring funds from customer accounts on the eve of the revocation of a bank license. Risks, protection.
The Central Bank has revoked the license from the Neiva Bank in Yekaterinburg, RBC reports.
The bank ranked 188th in terms of assets. According to the supervisory authority, he violated the legislation on combating money laundering and the financing of terrorism.
It is indicated that the regulator made such a decision, guided by the fact that the bank violated federal laws governing banking activities, as well as regulations of the Bank of Russia. In addition, the credit institution repeatedly violated the requirements of the legislation in the field of combating money laundering and the financing of terrorism.
Neiva Bank conducted significant volumes of dubious transactions for the sale of foreign currency in cash to individuals. A temporary administration has now been appointed to the bank, which will remain in effect until an insolvency representative or liquidator is appointed. At the same time, the powers of the creditor's executive bodies were suspended in accordance with federal laws.
By law, all deposits of individuals, individual entrepreneurs and small businesses are insured. It is important that the bank is included in the insurance system. Neiva is a member of this system. True, not everyone will be able to return the entire amount. The insurance system covers deposits up to 1.4 million rubles per depositor.
What are the implications for bank customers? Vitaly Vetrov, managing partner of the law firm Vetrov and Partners, will comment on this.
One of the key problems is the contestation of transactions for the transfer of funds from customer accounts on the eve of the revocation of the bank's license. This means that an ordinary entrepreneur who has sent money to his account, who has withdrawn part of the funds, can be recognized as having received benefits, put in an unequal position with other bank creditors and be obliged to return them back to the bankruptcy estate. Therefore, such clients should now carefully assess their situation, risks and attend to the formation of a position to protect their interests.
