A law was passed prohibiting banks from using foreign messengers in their work.
Under the new law, it is prohibited to use foreign (that is, owned by foreign legal entities or citizens) instant messengers to transfer banking information and information with personal data of citizens of the Russian Federation when providing public services or performing government tasks. In particular, the transfer of payment documents and information about transfers of funds, as well as data on accounts and deposits of citizens of the Russian Federation in banks, falls under the ban. Messengers will be prohibited from using in the implementation of various non-cash transactions.
The legal act defines instant messengers as information systems or programs intended for the exchange of messages by users exclusively within such systems. Popular Telegram, Viber, WhatsApp fall under these criteria. A complete list of messengers will be developed and published by the authorized state body, which in this case is Roskomnadzor.
The new law applies to credit and some non-credit financial organizations, for example, it mentions professional participants in the securities market, management companies, investment funds, non-state pension funds, depositories, etc. Also under the new rule will fall companies with state participation above 50%. The law will enter into force and apply on March 1, 2023.
Bill No. 141597-8 was submitted to the State Duma by deputy Anton Gorelkin, deputy head of the information policy committee. Earlier, in October 2022, A. Gorelkin proposed to ban state and municipal employees from using WhatsApp (the messenger belongs to the American corporation Meta, banned in Russia due to its recognition as extremist) for official purposes due to the fact that Russians are growing distrust of him.
In May, a law was already adopted that prohibited Russian credit institutions from sending data about their customers and their transactions to government agencies in Western and other countries that have imposed sanctions against the Russian Federation, citizens of the Russian Federation or legal entities.
On December 23, senators approved a law prohibiting Russian citizens from being forced to provide biometric information. Coercion to provide data by refusing to provide commercial or government services is not allowed. Biometrics will be processed and placed in a single state system.
