The Cherkizovo Group is demanding 448 million from Torgovaya Ploshchad for the illegal name of Servelat.
The Moscow company, the largest producer of meat products, PJSC Cherkizovo Group (plaintiff) filed a lawsuit against the Novosibirsk meat processing company Torgovaya Ploshchad (defendant). The subject of the dispute is the legality of the use of several trademarks. LLC "Samobranka", engaged in wholesale and retail trade, mainly in meat and meat products, was involved as a co-defendant. It was through the chain of stores of Samobranka LLC that the serverat with disputable names was sold. The amount of the claim, that is, the amount of claims made by the plaintiff, is 448,000,000 rubles. The statement of claim was accepted for consideration by the Arbitration Court of the Novosibirsk Region, the meeting is scheduled for September 27.
Plaintiff, in support of his claim, states the following:
the defendant is engaged in the production of two types of servelat with the names "Gubernsky" and "Borodinsky";
the defendant is engaged in the distribution of these meat products through a network of its stores, including an offer to purchase posted in an online store;
the right to use these names belongs to the meat processing plant in the capital, which belongs to the plaintiff, certificates have been issued for trademarks;
Permission to use the trademarks "Gubernsky" and "Borodinsky" was not received by the defendant from the JSC "ChMPZ" plant, license agreements were not signed either.
Based on the totality of these facts, the Cherkizovo Group concludes that it is possible to bring claims against the defendant for compensation for the harm caused. The representatives of the plaintiff also emphasized that they tried to settle the dispute out of court, but did not receive a response to the claim from Torgovaya Ploshchad. The calculation of the amount of compensation was made on the basis of data from government agencies (information on the volumes of products produced by the defendant with "illegal" names provided by the Rosselkhoznadzor) and from open sources (the price is displayed on receipts).
Torgovaya Ploshcha is significantly inferior to its opponent in terms of profits last year. The Cherkizovo group, owned by entrepreneurs Mikhailov, declared a net profit of 16.7 billion rubles in 2021, while Torgovaya Ploshchad showed a net profit of only 8.2 million rubles last year. For Samobranka LLC, this indicator for the same period is even less, only 6 million rubles. Both Novosibirsk enterprises belong to the Zyryanov brothers.
