The second penalty, like the first one, is negotiable (that is, it is calculated from the amount of the company's annual revenue, and is not set in a fixed amount). The grounds are similar to the first punishment - refusal to comply with the requirements of Roskomnadzor to remove content prohibited in the Russian Federation.

The amount of the fine is more than 21 billion rubles. The decision has not been published, but its issuance is confirmed by TASS journalists who were in court at the time the text of the document was announced, and the press service of the Tagansky District Court. The website of the justices of the peace of the city of Moscow also contains information that the judge of the court district No. 422 considered the case No. 05-1267 / 422 / 2022 on July 18, where the person involved is Google LLC, and issued a decision to impose an administrative penalty.

Since systematicity was established in the company's actions, the qualifying part of Art. 5 was immediately applied. 13.41 of the Code of Administrative Offenses of the Russian Federation, which provides for punishment in the form of a share of the annual proceeds, the amount of the penalty is determined by the court in a "fork" from 1/20 to 1/10. In this case, the judge chose the most stringent, maximum sanction provided by the legal norm.

The decision has not yet entered into force and the company has time to appeal.

The name of the offense for hours. 5 Article. 13.41 "violation of the order of access to information and resources", in fact, Google was fined for not responding to the notifications of the RKN and not eliminating the violations identified by the state agency. The RKN found that the YouToube resource, owned by Google, contains materials containing false information about the course of a special military operation, promoting extremism, also containing calls for participation in unauthorized mass actions, algorithms for creating dangerous substances and other prohibited content. The representative of the company, who was present at the meeting, did not agree with the imputed violations.

This is the second turnover fine the company has received for its neglect of content control on YouToube and its social networks. The first was appointed in December 2021, also immediately under Part 5 of Art. 13.41 of the Code of Administrative Offenses of the Russian Federation (in 2021, the court considered 16 protocols against Google for illegal content) and amounted to 7.2 billion rubles, later it was paid by Google, the company has a daughter in Russia under the law on landing. In June, Google LLC filed for bankruptcy due to the arrest of invoices imposed on the claims of TV channels blocked by YouTube.
