The former general director of the football club "Siberia" (the legal form of the company is a Limited Liability Company) will not be held liable for the LLC's debts. Konstantin Krichevsky was appointed to this post in 2012, when the financial situation of FC Sibir LLC was already difficult. In 2020, the club was declared bankrupt and ceased to exist after 84 years of activity, it was founded in 1936. The insolvent was initiated by the Spartak stadium, to which a debt of about 35 million rubles was formed.In total, the debt of OOO FC Sibir amounted to about 75 million rubles.
In March 2022, the bankruptcy trustee of the LLC, Sergey Lebedev, filed a lawsuit with the Arbitration Court of the Novosibirsk Region to bring Krichevsky to subsidiary (additional) liability. The manager sued the ex-director of the club in the amount of 51.7 million rubles.
Lebedev substantiated his statement of claim against Krichevsky by failing to fulfill his obligation to file an application for voluntary bankruptcy with the court. The bankruptcy trustee believes that when he was the head of the club, Krichevsky, knowing about the financial condition of the club and the presence of signs of bankruptcy, did not apply to the Arbitration Court with a corresponding initiative.
The court refused to satisfy the demands and began to recover the debts of the football club from the ex-director. The decision notes the social significance of the company and its activities for the residents of the region for the development of Novosibirsk football.
The court considered that the former CEO acted reasonably in deciding to continue working in a difficult period, despite formal financial indicators. In addition, he acted with the approval of the founders of the club.
The decision of the Arbitration Court of the Novosibirsk Region notes that Krichevsky took the necessary measures to increase the solvency of the LLC he manages, made attempts to obtain additional income and make settlements with creditors.
In addition, it is noted that, in fact, the club, having the status of a commercial organization, did not act only for profit, but solved socially significant issues, and was highly dependent on budget revenues. The bankruptcy of the club, the court considered, was the result of its removal from the Russian football championship after the creation of the autonomous non-profit organization FC Novosibirsk.
