Criminal liability for public insult of a representative of the authorities.

The State Duma has drafted a bill to criminalize public insult of a representative of the authorities on the Internet or in the media. The proposed punishment for such a crime includes a fine of up to 1 million rubles, compulsory labor for up to 480 hours, compulsory labor for up to two years or imprisonment for the same term.

In addition, amendments are made to Article 319 of the Criminal Code of the Russian Federation (insulting a representative of the authorities). Now the punishment under this article is a fine of up to 40,000 rubles, or compulsory labor for up to 360 hours, or correctional work for up to one year. It is proposed to double the fine, as well as to increase the maximum term of compulsory and corrective labor - up to 460 hours and two years, respectively.

In 2023, the Supreme Court of the Russian Federation clarified when insulting a representative of the authorities is criminalized. It specified that insulting a public servant consists in “public humiliation of honor and dignity, committed in the performance or in connection with the performance of the victim's official duties.” It can be expressed in public swearing at the official, placement of derogatory information in the media or on the Internet, as well as in public actions that humiliate the honor and dignity of the official.

The court noted that 5,912 people were convicted under Article 319 of the Russian Criminal Code in 2022.
