The Federal Antimonopoly Service will not initiate proceedings on the complaint of book publishers against Yandex and Mail.ru Group, RBC reports on March 3. The companies were accused of violating antitrust laws.
The Internet Copyright Protection Association (Eksmo-AST, Azbuka-Atticus, Alpina Publisher and other publishers) complained that search engines and social networks prefer video services to remove pirated content. However, the FAS stated that publishers and Internet companies operate in different markets and there are no reasons for unfair competition. The FAS refused to recognize discrimination against book publishers.
The claim against Mail.ru Group is that the company does not distribute digital fingerprint technology to Odnoklassniki, which already allows it to be detected on VKontakte. In November 2018, a memorandum was signed requiring Yandex to remove links to pirated content from its out-of-court publications. Now the Association for the Protection of Copyright on the Internet plans to appeal this decision and will file a complaint with the Prosecutor General's Office about the violation of the procedure for considering appeals by the service.
Last year, the Internet Copyright Protection Association complained that the distribution of pirated copies of books on Telegram deprived publishers of about 60 billion rubles in profits.
Mail.ru Group representative Sergey Luchin considered the association's appeal strange, since the issue of relations with AZAPI lies outside the scope of antimonopoly regulation. His opinion will be commented on by Kristina Kornoukhova, a lawyer at the law firm Vetrov and Partners.
In fact, protecting one's rights, especially for the results of intellectual activity, is sometimes a thankless task.
