It is reported that the Ministry of Finance finalized the bill on mining and circulation of digital currency, it is not yet freely available, but the authenticity of the document that got into the media is confirmed by two sources.
The draft law made the first attempts to legally regulate mining, and also established that digital currency can be used for payments and investment. The requirements for operators and investors look overly stringent, but the state opens up new opportunities for miners to get out of the gray zone.
According to the bill:
- the terminology, the basic requirements for accounting, identification and certification are fixed (they will not affect objects outside the Russian information space). For example, a legislative definition of "electronic digital wallet" is introduced and an obligation for its mandatory certification is introduced. How it is supposed to carry out certification in the document is not specified;
- digital currency will be allowed to be used as a means of payment that is not the monetary unit of the Russian Federation. It can also be used for investment. A requirement was established for the absence of an obligated person in relation to her;
- the main "players" of the virtual currency market have been identified, who will be responsible for the circulation of digital currencies - exchange operators (they are granted the right to buy and sell on their own behalf by placing a public offer) and digital trading platform operators (authorized to organize trading). In this case, the first will need a capital of 30,000,000 rubles, and the second - 100,000,000 rubles;
- in addition to capital, compliance with other strict requirements will also be required. Thus, the need to obtain a license to carry out activities in the field of digital currencies and the obligation to maintain a register of its owners is introduced. All applicants, in addition, must be registered in Russia, foreigners will need to open a business company in the Russian Federation in order to obtain a license;
- to make purchase and sale transactions, identification will be required, to withdraw fiat currency - a bank account;
- for miners (legal entities and individual entrepreneurs) they will also create a separate registry and allow the use of data centers, if they belong to a Russian legal entity. It is planned to introduce a separate taxation regime for miners.
All these rules will apply only to the Russian information infrastructure, Russians will also be allowed to use foreign exchanges.
