Bankruptcy without deception: new rules for advertisers

Bankruptcy without deception: new rules for advertisers.

A new bill has been submitted to the State Duma aimed at establishing restrictions on the advertising of bankruptcy services. The main objective is to prevent misleading information and ensure transparency regarding the potential consequences of bankruptcy.

According to the bill, advertisements for bankruptcy services must comply with the following requirements:
Not guarantee exemption from monetary obligations or payment of mandatory fees. This means that advertisements must not create false hopes in potential clients that bankruptcy will allow them to be completely free of their debts.
Do not contain appeals to non-payment of debts or claims that all obligations can be discharged. Advertisements should emphasize that bankruptcy is a serious step that can have negative consequences, rather than presenting it as an easy way out of financial difficulties.

Do not mention that the government has created a system for freeing citizens from monetary obligations. This means that advertising should not give potential clients the impression that the government provides special programs or benefits for debt relief.
Be sure to point out the possible negative consequences of bankruptcy, including limitation of rights. This means that advertisements must clearly inform potential clients that bankruptcy may result in restrictions on their rights, such as the right to obtain credit or participate in certain activities.
These requirements are intended to ensure that advertisements for bankruptcy services are transparent and do not mislead potential clients. They are intended to help people make informed decisions about bankruptcy by understanding all the potential consequences of this step.

In addition, the bill establishes specific requirements for the placement of information about the negative consequences of bankruptcy in advertising. For example, in radio commercials, this information must be heard for at least three seconds, in TV commercials it must occupy at least 10% of the screen, and in other forms of advertising it must occupy 10% of the advertising space. Advertisers will need to take special care to ensure that information about the potential consequences of bankruptcy is clearly visible and audible to potential clients.
