A criminal case has been initiated against the former head of a village in the Novosibirsk Region. Excess of authority, responsibility.
The press service of the Investigative Department of the Investigative Committee of the Russian Federation in the region announced the initiation of a criminal case on the fact of abuse of power by one of the former heads of the municipality. The specific name of the former official has not yet been disclosed, however, the media have already managed to "figure out" him.
A criminal case was initiated by law enforcement officers under paragraph "c" part 3 of Art. 286 of the Criminal Code of the Russian Federation. This norm provides for punishment for exceeding official powers committed by the head of a local self-government body, which entailed grave consequences. That is, this is a qualified composition of the article, the act is punishable only by imprisonment from 3 to 10 years, the specific term is set by the judge based on the specific circumstances of the case. An additional punishment is also provided - deprivation of the right to hold such positions for up to 3 years.
The materials on the event were collected by the Department of the Federal Security Service of the Russian Federation for the region. Formally, the former head of the municipality is charged with paperwork and an order to make payments without the necessary documentation. What caused damage to the administration of an urban-type settlement in the region in the amount of more than 8 million rubles, this amount in accordance with paragraph "c" part 1 of Art. 286 of the Criminal Code of the Russian Federation is a major damage.
Law enforcement officers see in the actions of the ex-head a violation of the legislation in the field of procurement. The investigation found out that the administration of the Moscow Region held open electronic auctions, the purpose of which was to find contractors for the construction, as it required the construction of a capital facility. Auctions took place, the winner in the person of a specific legal entity was chosen. A contract was signed with him, the amount of which exceeded 8 million rubles.
The contractor fulfilled its obligations, capital construction facilities were erected, in connection with which the customer received acceptance certificates for the work performed. The former head of the municipality signed these acts and gave an order to pay for the work performed until a positive expert opinion was received, which is contrary to the law. The investigation believes that these actions caused damage to the budget of the village. Informed sources claim that in this case we are talking about the former head of the Linevo village of the Iskitimsky district, Yakov Landais. He was the head of Linevo from 2010 to 2019, in July 2021 he was replaced by Dmitry Grusheva. Earlier it became known about the initiation of a criminal case in connection with the violation of the procurement procedure for the municipality against another former official from the Novosibirsk region, the mayor of the city of Cherepanov.
